Spigen claiming Essential Phone infringes on trademark

Essential is a new company started by Andry Rubin that has created the Essential Phone, a brand new phone with some interesting features. Features like a nearly bezel-free display with a cutout for the camera, a ceramic back and titanium frame, and Andy Rubin’s backing have caught many people’s eye. Unfortunately, it also caught some negative attention too. It seems the company may be infringing on someone else’s trademark.

Spigen has accused Essential of trademark infringement over its “Essential” line of accessories. Though Spigen does not make a phone, it says that the naming will cause confusion with consumers. Owning the trademark for the name Essential, it has sent a cease and desist to the phone maker.

While Essential has not officially responded, it will be interesting to see what happens to the new company. Essential is a pretty generic name so it might work out, though the company was allegedly denied by the USPTO twice.
